Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of Setu, the AI sales agent for real estate built by Kartavya Technology ("Kartavya Technology", "Setu", "we", "us", or "our"), including this website (gosetu.co), the Setu dashboard, and the WhatsApp-based conversational service (together, the "Service"). By creating an account, signing an order form, or otherwise using the Service, you agree to be bound by these Terms on behalf of yourself and, if applicable, the business you represent ("Customer", "you").

If you do not agree to these Terms, do not use the Service. If these Terms conflict with a signed order form or master services agreement between you and Kartavya Technology, that signed agreement controls.

2. The Setu service

Setu responds to inbound real estate buyer inquiries over WhatsApp on behalf of Customers, using the property information, pricing, and materials the Customer provides, to qualify leads, answer questions, share documents, and schedule site visits. Setu does not itself broker, sell, or guarantee the sale of any property, and does not provide legal, financial, or investment advice — those remain the Customer's responsibility.

We may update, add to, or remove features of the Service from time to time to improve performance, security, or functionality.

3. Accounts & eligibility

  • You must be at least 18 years old and authorized to act on behalf of the business you represent to create an account.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • You must provide accurate account and billing information and keep it up to date.
  • Notify us promptly at hello@kartavyatech.com of any unauthorized use of your account.

4. Your responsibilities

As a Customer, you are responsible for:

  • The accuracy of the property listings, pricing, floor plans, and other content you upload for Setu to use in conversations with buyers.
  • Ensuring you have the right to share any content, images, or documents you upload.
  • Complying with WhatsApp's Business Messaging Policy, Meta's terms, and applicable telemarketing, consumer-protection, and data-protection laws when messaging buyers — including only messaging numbers that have opted in or initiated contact, as required by WhatsApp and applicable law.
  • Honoring buyer opt-out requests (e.g., "STOP") promptly.
  • Reviewing Setu-generated responses where appropriate and correcting any property information that becomes inaccurate or outdated.

5. Acceptable use

You agree not to use the Service to:

  • Send spam, unsolicited bulk messages, or messages to individuals who have not opted in or otherwise initiated contact;
  • Upload false, misleading, or discriminatory property listings or pricing;
  • Attempt to reverse-engineer, scrape, or interfere with the Service's underlying software or infrastructure;
  • Use the Service for any unlawful purpose, or in a way that infringes the rights of buyers or third parties; or
  • Circumvent usage limits, security controls, or access restrictions on the platform.

We may suspend or terminate access for any account that violates this section.

6. Fees & billing

Paid plans are billed according to the pricing and billing cycle presented at sign-up or in your order form. Unless stated otherwise, fees are non-refundable and exclusive of applicable taxes, which you are responsible for. We may change our pricing for future billing cycles with reasonable advance notice. Failure to pay fees when due may result in suspension or termination of access to the Service.

7. Third-party services

Setu relies on third-party infrastructure to operate, including the WhatsApp Business Platform (provided by Meta Platforms, Inc.) and third-party AI language model providers (currently including Anthropic) used to generate conversational replies. Your use of Setu is also subject to WhatsApp's Business Messaging Policy and Meta's applicable terms. We are not responsible for outages, policy changes, or account actions taken by these third-party providers that are outside our control, though we will make reasonable efforts to minimize disruption to the Service.

8. Intellectual property

Kartavya Technology retains all right, title, and interest in and to the Setu platform, software, branding, and underlying technology. Customers retain ownership of the property listings, brochures, pricing, and other content they upload ("Customer Content"). By uploading Customer Content, you grant Kartavya Technology a limited, non-exclusive license to use, store, and process it solely to provide and improve the Service to you.

9. Confidentiality & data

Each party will protect the other's confidential information using reasonable care and will not disclose it except as needed to perform under these Terms, as permitted by the other party, or as required by law. Personal information collected and processed through the Service is handled as described in our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-generated responses may occasionally be inaccurate or incomplete; we do not guarantee that every reply will be error-free, and Customers are responsible for reviewing critical property information communicated through the Service. We do not guarantee any specific sales, lead-conversion, or booking outcomes.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KARTAVYA TECHNOLOGY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE FEES YOU PAID TO US FOR THE SERVICE IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify and hold Kartavya Technology harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your Customer Content, your violation of these Terms, or your violation of applicable law, including WhatsApp's messaging policies or data-protection laws.

13. Term & termination

These Terms remain in effect for as long as you use the Service. You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms and do not cure the breach within a reasonable period after notice, or immediately in cases of serious violations (e.g., illegal use or abuse of the Service). Upon termination, your right to use the Service ends, though provisions that by their nature should survive (e.g., payment obligations, confidentiality, limitation of liability) will continue to apply.

14. Governing law & disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India, unless otherwise agreed in a signed order form.

15. Changes to these terms

We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. We will update the "Effective date" above when we do, and for material changes, we will provide reasonable notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
